Ban on gender change proposed in Kyrgyzstan

Amendments to the Family Code, the Law on Civil Status Acts, and the Law on the Protection of Citizens’ Health have been submitted for public discussion in Kyrgyzstan.

The bill, published on the parliament’s website, states that a person’s gender is determined exclusively by biological characteristics recorded at birth in the birth certificate, and it cannot be changed either at the request of the citizen or on the basis of medical reports or a court decision.

The bill prohibits any actions aimed at altering minors’ sexual identity or instilling in them ideas about the possibility of gender reassignment by medical, surgical, and psychological interventions. Parents are obligated to raise their children in accordance with their biological sex.

Medical interventions (surgical operations and hormonal therapy) for the purpose of changing the sex (transgender transition) of a person are prohibited, with the exception of cases of treatment of congenital anomalies of sexual development confirmed by the conclusion of a medical commission and a court decision.

The bill’s authors emphasize that the amendments are aimed at protecting family values ​​and demographic security, preserving Kyrgyzstan’s cultural identity and traditional values, and preventing legal conflicts.

The bill’s explanatory note says that current legislation does not contain clear provisions governing gender reassignment, which creates risks for demographic policy, child protection, and the sustainability of government document flow.

The authors refer to social-media reports on the first-ever application for gender reassignment in Kyrgyzstan, which, in their opinion, signals the urgent need for legislative regulation of this issue in order to protect constitutional foundations and traditional values.
